To use or access the Platform, you must be competent to enter into a contract under applicable laws. You must also be at least 21 years old. By continuing to use the Platform, you represent and warrant that you meet this requirement.

You may create a Velouria Account using your email or mobile number (verified via OTP), or proceed as a Guest. Guest users may not access features such as order tracking or saved addresses.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You acknowledge that information you provide does not infringe any third-party rights.

If you believe your account security has been compromised, contact us immediately at support@thevelvetsecrets.com. We may require a password change or temporarily suspend your account without liability.

We reserve the right to terminate your account or refuse product sales without prior notice if you violate these Terms, or if we cease to provide the Platform or its features.

• We grant you a limited, non-exclusive, non-transferable, revocable license to access and make personal, non-commercial use of the Platform and Products.
• You may not download, copy, reverse-engineer, or use our Platform or Products for any other purpose without prior written consent. All rights not expressly granted are reserved by us.
• We may terminate your license and prevent future access at any time, at our sole discretion and without notice.

• Product Accuracy: We strive for accuracy in all product descriptions. However, we do not warrant that descriptions, colors, or other content are entirely error-free. Visual images are indicative and may slightly vary from the actual product delivered.
• Commercial Resale Prohibited: All products are for your personal use only. You shall not resell or use our products for any unauthorized commercial purposes.

• Third-Party Gateways: We use secure third-party payment providers. We are not liable for transaction failures, data breaches, or fraudulent activities originating from third-party ecosystems.
• Taxes: All product prices on the Platform are inclusive of GST and all other applicable taxes, duties, and cesses, unless otherwise stated.

All shipping, delivery, cancellation, return, and refund operations are governed by our dedicated Shipping & Returns Policy.

• Platform Availability: The Platform is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation.
• Not Medical Devices: Our products are wellness and lifestyle items. They are not medical devices, drugs, or medicines and do not possess medicinal or therapeutic properties.
• Information Disclaimer: Content on our Platform, social media, or newsletters is for informational purposes only and does not constitute professional medical advice, diagnosis, or treatment.

• Ownership: All rights in the Platform — including its layout, trademarks, brand names, copyrights, source code, imagery, and graphics — constitute the exclusive intellectual property of The Velvet Secrets Velouria.
• Prohibited Use: You may not duplicate, distribute, create derivative works of, extract code from, or commercially exploit our intellectual property without explicit prior written permission.

In no case shall The Velvet Secrets Velouria, our directors, officers, employees, affiliates, agents, or licensors be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Platform, Products, or Information.

You agree to defend, indemnify, and hold harmless the Company from all claims, damages, losses, and costs (including attorney's fees) arising from:

While using the Platform, you agree NOT to host, upload, display, or share content that:

• Is illegal, prohibited, harmful, or fraudulent.
• Infringes anyone's copyrights, trademarks, or privacy rights.
• Contains software viruses, malware, or destructive computer code.
• Is hateful, threatening, or encourages violence or public disorder.
• Deceives, misleads, or intentionally spreads false information.
• Attempts to reverse-engineer, mirror, or unlawfully scrape content from the Platform.

By accessing our Platform, you consent to receive communications from us electronically — including operational updates, purchase confirmations, promotional notifications, and newsletters — via email, WhatsApp, SMS, or on-platform notices. All such electronic notifications fulfill legal requirements for written communication.

For any complaints or grievances related to our Platform, Products, or Information:

• Response Window: We acknowledge grievances within 24 hours and aim to resolve within 15 days of receipt.

• Jurisdiction: These Terms are governed by the laws of the Republic of India. All legal disputes are subject to the exclusive jurisdiction of courts in Mumbai.
• Arbitration: Disputes shall be resolved by a mutually appointed sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue shall be Mumbai, proceedings in English.

• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
• Force Majeure: We will not be held responsible for delays or failures arising from causes beyond our reasonable control — including acts of God, pandemics, civil unrest, strikes, or major logistical disruptions.
